Introduction

These Terms & Conditions ("Terms") govern your use of the Session One Studios website at sessionone.studio and the photography services we provide. By booking a session, using our website, or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

Session One Studios reserves the right to update these Terms at any time. The most current version will always be available on our website. Continued use of our services after any update constitutes acceptance of the revised Terms.

1. Services

Session One Studios provides professional photography services including, but not limited to, personal branding photography, corporate headshots, portrait photography, and commercial photography.

All sessions are subject to availability and must be booked in advance. Session One Studios reserves the right to decline or discontinue services at its discretion.

2. Booking & Confirmation

A session is not confirmed until a deposit has been received and a booking confirmation has been issued by Session One Studios. Confirmation will be sent to the email address provided at the time of booking.

By completing a booking, you confirm that:

• The information provided is accurate and complete
• You are at least 18 years of age, or have obtained parental or guardian consent
• You agree to these Terms in full

3. Deposits & Payment

Deposit

A non-refundable deposit is required at the time of booking to reserve your session date and time. The deposit amount will be applied toward the total session fee.

Remaining Balance

The remaining balance is due in full on or before the day of your session, prior to the session beginning. Session One Studios reserves the right to withhold delivery of images until full payment has been received.

Accepted Payment Methods

Accepted payment methods are outlined during the booking process. All payments are processed securely. Session One Studios does not store credit card or banking information.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price confirmed at the time of booking will be honored for that session.

4. Cancellations & Rescheduling

Cancellation by Client

• Cancellations made more than 48 hours before the scheduled session: the deposit will be forfeited, but no additional charges will apply.
• Cancellations made within 48 hours of the scheduled session: the deposit will be forfeited and the full session fee may be charged.
• No-shows (failure to arrive without prior notice): the full session fee will be charged.

Rescheduling by Client

Each booking includes one complimentary reschedule, provided notice is given at least 48 hours before the scheduled session. All subsequent reschedule requests are subject to a $25 rescheduling fee per occurrence. Rescheduling requests made within 48 hours of the session are subject to the $25 fee regardless of how many prior reschedules have occurred, and are accommodated based on availability.

Cancellation by Session One Studios

In the event that Session One Studios must cancel a session due to unforeseen circumstances (e.g., equipment failure, illness, emergency), clients will be offered a full refund of their deposit or the option to reschedule at no additional cost. Session One Studios is not liable for any additional costs or losses incurred as a result of such cancellation.

5. Late Arrivals

Sessions begin at the scheduled start time. If you arrive late, your session will still end at the originally scheduled time and the full session fee will apply. If you anticipate being late, please contact us as soon as possible. Arrivals more than 20 minutes late without prior notice may be treated as a no-show at the studio's discretion.

6. Client Responsibilities

To ensure the best possible results from your session, you agree to:

• Arrive on time and prepared (appropriate attire, styling, etc.)
• Communicate any specific needs, preferences, or concerns prior to the session
• Ensure that all individuals participating in the session (including minors) are present and prepared

Session One Studios is not responsible for unsatisfactory results arising from a client's failure to communicate preferences, arrive prepared, or follow reasonable guidance during the session.

7. Minors

Sessions involving individuals under the age of 18 require the presence of a parent or legal guardian throughout the session. A parent or guardian must sign all applicable release forms on behalf of the minor. Session One Studios reserves the right to halt or refuse a session if proper consent has not been provided.

8. Image Delivery

Turnaround Time

Edited images will be delivered within 5 business days of the session date via a private online gallery link sent to the email address on file.

Image Selection

The images selected for editing and delivery are chosen at the professional discretion of Session One Studios. Raw (unedited) files are not provided to clients. Exceptions may be made for commercial clients operating under a separate licensing agreement that explicitly includes raw file delivery.

Gallery Access

Online galleries are available for 14 days from the date of delivery. Clients are responsible for downloading and saving their images within this period. Session One Studios is not liable for images that are lost after gallery expiration.

9. Copyright & Image Usage

Session One Studios retains full copyright ownership of all photographs created during a session. The delivery of images to a client constitutes a limited personal and professional use license, not a transfer of copyright.

What You May Do With Your Images

• Use images for personal purposes, social media profiles, professional profiles (e.g., LinkedIn), and personal websites
• Use images for professional marketing materials directly related to your personal brand or business

What You May Not Do Without Written Permission

• Resell, sublicense, or transfer images to third parties
• Use images in paid advertising campaigns without a commercial licensing agreement
• Alter or manipulate images in a way that misrepresents the original work
• Remove or obscure any embedded metadata or copyright information

10. Studio's Right to Use Images

Unless a written opt-out is requested prior to the session, Session One Studios reserves the right to use photographs created during a session for the following purposes:

• Portfolio display (website, print, in-studio)
• Social media and marketing materials
• Promotional and advertising content

Clients who wish to opt out of this usage must submit a written request before their session date. Opt-out requests will be honored in full and will not affect service quality.

11. Limitation of Liability

Session One Studios' total liability to any client for any claim arising out of or related to a session or these Terms shall not exceed the total amount paid by the client for that session.

Session One Studios is not liable for:

• Loss or damage to personal belongings brought to the studio
• Dissatisfaction arising from client failure to communicate preferences
• Technical failures beyond our reasonable control (e.g., equipment malfunction, data loss after image delivery)
• Any indirect, incidental, or consequential damages of any kind

In the event of a significant technical failure that prevents delivery of usable images, Session One Studios' sole obligation shall be to offer a reshoot or a full refund of fees paid.

12. Conduct & Right to Refuse Service

Session One Studios is committed to maintaining a safe, respectful, and professional environment. We reserve the right to immediately terminate a session — without refund — if any individual engages in behavior that is disruptive, threatening, harassing, or otherwise inappropriate.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

14. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith communication. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, before pursuing litigation.

15. Entire Agreement

These Terms, together with any booking confirmation and applicable release forms, constitute the entire agreement between you and Session One Studios with respect to your session and supersede all prior communications, representations, or agreements.
